A 34-year-old Port Washington man accused of making a video of himself having sex with his unconscious girlfriend pleaded no contest in Ozaukee County Circuit Court last week to a felony charge of second-degree sexual assault of an unconscious person.

Assistant District Attorney Patti Wabitsch recommended the man be ordered to serve five years in prison and 10 years of extended supervision when he is sentenced by Judge Sandy Williams on April 10.

Ozaukee Press is not naming the man to protect the identity of the victim, who told authorities she had been in a relationship with the man for about 10 years, and their child.

In October, the woman reported to police that she had become concerned that the man was using drugs and, while searching his cell phone for evidence of a drug habit, found photos and videos of herself on his phone.

In one video, the woman said, she was taking a shower and the man had apparently cracked open the door to record her, according to the complaint.

The woman said that another, more disturbing, video showed the man having sex with her in her bedroom when she was unconscious. She said she did not move in the video and does not remember the assault. She said she does know, however, that it happened on Sept. 23 because she recognized from the video what she was wearing that day and remembered waking up without pants on.

After seeing the videos, the woman questioned the man and recorded the confrontation. In the video, which she gave to police, the man confessed to sexually assaulting her, the complaint states. He said he only did it once.

Second-degree sexual assault is punishable by a maximum 25 years in prison and 15 years of extended supervision.
