Men charged with sexually assaulting woman in Port basement

Victim says she was intoxicated when 19-year-olds assaulted her, according to complaint

Two Port Washington men, both 19, were charged in Ozaukee County Circuit Court this week with sexually assaulting a woman at the same time on Sunday, March 15.

Erik J. Ziehr and Joshua M. Black each face one felony count of first-degree sexual assault. Ozaukee County Circuit Court Judge Steve Cain on Tuesday set Ziehr’s bail at $50,000 and Black’s at $40,000.

According to the criminal complaint, a 20-year-old woman told police that on Sunday she and two female friends were drinking with Ziehr and Black in the basement of Black’s house. She said she drank five shots of vodka and one alcoholic drink and felt extremely intoxicated, more so than she had in the past after drinking that much.

The woman said she was laying on a couch when Ziehr removed her clothing and sexually assaulted her, the complaint states. She said she was drifting in and out of consciousness at the time.

The woman said she also remembered waking up to find Black assaulting her. When he stopped, Ziehr assaulted her again, and at one point the men assaulted her at the same time, according to the complaint. She said that the men were moving her around and holding her in various positions because she was too intoxicated to control her body.

At one point during the evening, the woman said, Ziehr and Black drove her around in her car debating whether they should seek medical attention for her, the complaint states.

She told police she wound up back at Black’s house where she woke up naked on the basement floor.

The woman, who sought medical treatment, had bruises on her chest and the inside of her right arm as if someone had grabbed her forcefully. She also had abrasions on her forehead from having her head pushed into the carpeting while being assaulted and on her knees, according to the complaint.

When interviewed by an officer, Ziehr said the woman was quite intoxicated and admitted to having sex with her, but he maintained the woman consented, the complaint states.

Black told an officer that he had sex with the woman while Ziehr was having intercourse with her because Ziehr told him to. When asked if the woman consented to having sex with them, Black said that she didn’t say no, but added that she was so intoxicated that he was unsure whether she could have said no, according to the complaint.
